Question by Amit KK: Possession of incomplete flat.?
I brought a flat in Pune last year. The completion date was december 2010. It was delayed for reason the builder is not ready to disclose. Now after lot of calls and meeting with builder he is ready to give the possession of flat. The interior is all done but the following is still not complete.
1.) Lifts not working.
2.) No electicity meters are allocated.
3.) Work is still in progress for the layouts and garage.
The builder is not ready to pay any penalty for delay. And now since he is ready to hand out the key should i take it or wait for the building completion. I am staying in rented flat hence i have to shell out money for EMI as well as rent. Please suggest something.

If you have a contract with the builder that specifies a time of completion then you can sue him for your money back and an additional penalty and using that money you can hire another one to rebuild or finish the work.

If you don’t have a contract, then you’re screwed.
